Disclaimer
SPWD will not be held responsible for any inaccuracies or errors, delays or unobtainability arising from the site or the host for any reason whatsoever. Any problems with the site must be reported as soon as possible and will be rectified as soon as practical. No responsibility will be accepted as to any losses or problems arising from the site for any reason unless specifically agreed beforehand.

General
All original designs, artwork, original graphics and photography remain the sole property of SPWD, and may not be used or reproduced by any means without prior consent.
All offers are subject to contract.
Prices quoted here are subject to change and should be agreed at the time of contract.
Websites provided on a 'design only' basis are the property and responsibility of the client following publication and payment.
I reserve the right to add a small text and/or graphic link back to this site to all pages of a free design, and a minimum of one page in all other cases.
SPWD reserves the right to alter these terms without notice, and whilst every effort is made to be accurate and up-to-date, errors and omissions are excluded
Initial free Package
All websites designed and published under the free design offer remain the sole property of, and under the control of SPWD for the first 2 years following publication.
All webspace and names provided under the free design offer remain the sole property of, and under the control of SPWD, and will continue to host your site for the duration of the maintenance contract.
Designs provided under the free design offer are limited to 5 pages of HTML and Javascript, and a total of 25 graphics and or photographs. Graphics are all designed 'in-house' and scanning and optimisation for your photographs provided. Additional pages/graphics/photographs are available subject to a design cost.
If you wish to cancel the maintenance contract, you may at any time. Your website and webspace will be cancelled and your Domain Name and site will be offered back to you, subject to the terms of the normal design package.
You may provide your own Domain Name and webspace and still have a free design. The monthly maintenance cost is unchanged.

Site Design
The site design will be deemed to be complete when you agree to publication.
The site will be published subject to payment as agreed in the contract, whether written or verbal.
If a name is registered, it is your responsibility to pay the registration fees in advance to retain the name.
Prices for sites are in two parts - the design fee and the name and hosting fees.
The site will be published when the design is agreed and completed and payment received, further changes then come under a maintenance contract.

Promotion
Search engine registration provided under the free design offer is in association with various site promotion agencies and subject to change.
Search engine registration provided under a normal site design is hand submitted to 10 search engines after publishing.
Additional promotion is available and additionally subject to the terms of the promotion company chosen for the job.
All websites are designed with optimised meta tags and alt descriptions to assist search engine ratings and, where possible, the content is optimised for searching also.
Maintenance
Monthly maintenance contracts of £15-£40 per month (price dependant on package chosen) cover one hour per month maintenance.
Further maintenance or other work will be charged in multiples of one hour.
Maintenance includes any changes or additions you wish to make to the site, or promotional activities, within the time paid for.

Secure Server
Secure server access is provided by Thwaite. Encryption is 40 bit - suitable for most online stores.
Processing of orders are the responsibility of the site owner, as is processing any sales with your merchant account.
The setup of merchant accounts is the responsibility of the site owner.

Domain name registration and hosting services
Domain names are registered with the most suitable provider at the time.
SPWD reserves the right to register and host with the most suitable company, however no responsibility can be assumed for any problems whatsoever arising from these choices, and the site owner must abide by any such terms put forward by the host. Typical additional terms are as follows:

Hosting Terms

We make no representation and give no warranty as to the accuracy or quality of information received by any person via the Server and they shall have no liability for any loss or damage to any data stored on the Server.
You shall effect and maintain adequate insurance cover in respect of any loss or damage to data stored on the Server.
You represent, undertake and warrant to us that you will use the Web Site allocated to you only for lawful purposes. In particular, you represent, warrant and undertake to us that you will not use the Server in any manner which infringes any law or regulation or which infringes the rights of any third party, nor will you authorise or permit any other person to do so. You will not post, link to or transmit (a) any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable in any way; (b) any material containing a virus or other hostile computer program; (c) any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.
You shall keep secure any identification, password and other confidential information relating to your account and shall notify us immediately of any known or suspected unauthorised use of your account or breach of security, including loss, theft or unauthorised disclosure of your password or other security information.
You shall observe the procedures which we may from time to time prescribe and shall make no use of the Server which is detrimental to our other customers.
You shall procure that all mail is sent in accordance with applicable legislation (including data protection legislation) and a secure manner.
In the case of an individual User, you warrant that you are at least 18 years of age and if the User is a company, you warrant that the Services will not be used by anyone under the age of 18 years.
Any access to other networks connected to the host must comply with the rules appropriate for those other networks This specifically. but not exclusively, includes NetKonect and PSI Net.
While we will use every reasonable endeavour to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorised users or hackers and we shall be under no liability for non-receipt or misrouting of email or for any other failure of email

Service availability
We shall use our reasonable endeavours to make available to you at all times the Server and the Services but we shall not, in any event, be liable for interruptions of Service or down-time of the Server.
We shall have the right to suspend the Services at any time and for any reason, generally without notice, but if such suspension lasts or is to last for more than 30 days you will be notified of the reason.
The Services provided to you hereunder and your account with us cannot be transferred or used by anyone other than you. No more than one log-in session under any one account may be used at any time by you. If you have multiple accounts, you are limited to one login session per system account at any time; user programs may be run only during log-in sessions. If your account is found to have been transferred to another party, or shows other activity in breach of this subclause, we shall have the right to cancel the account and terminate the Services and/or this Agreement immediately.
